1. Prices and Payment
All prices in the catalogue are quoted in Great British Pounds (£) and are valid until 30th April 2012.  This catalogue supersedes all previous catalogues.
VAT is payable at the prevailing rate.  All prices in this catalogue are inclusive of VAT at the rate of 20%.
Payment in full is required upon our receipt of your order.
We reserve the right to defer dispatch of an order pending clearance of payment.

2. Dispatch and Delivery
Orders will start being dispatched in November 2011.  All orders are dispatched in the order they are received.  Roses may be ordered online, by post or by calling our sales office.
All items are packaged in our secure, specifically designed packaging to ensure your order reaches you in nursery fresh condition. 
No charge is made for orders collected from us.  We require 48 hours notice from customers if they wish to collect their order to allow time for the order to be made up.  If an order is not collected within two weeks of arrangement, it will be returned to stock.
Please note if you specify a dispatch date on the Order Form, this is the date the order will be dispatched and we accept no responsibility in respect of the date of delivery.
For orders to be shipped to more than one address, the Carriage and Packing Charges will apply to each address.
The free delivery offer is not available on orders containing Standard Roses or orders to be shipped to more than one address or out with the UK.
The Carriage and Packing Charges apply to UK mainland and Northern Ireland only.
The Carriage and Packing Charges for orders to be dispatched to the Channel Islands and the EU will be determined upon dispatch and your credit card automatically debited the full cost.
Standard Roses cannot be shipped to the Channel Islands or EU countries.
We do not ship orders out with the UK, the Channel Islands or the EU.

 3. Descriptions
Our roses are sold as bare root roses and will not be in bloom at the time of dispatch.
Whilst we endeavor to provide descriptions that accurately reflect our interpretation of the plant whilst in bloom, as with any living product the descriptions will not match every plant in bloom as this will vary due to climate and ground conditions.
Photographs are purely for illustrative purposes and customers should allow for a degree of colour variance as a result of the printing process.

4. Substitutes
In the unlikely event of your requested rose being sold out, we can either (a) dispatch your preferred substitute varieties, (b) use our discretion in providing a similar replacement variety of equal or greater value or (c) give you a full refund.  Please state your preference in the Order Form. We reserve the right to substitue any variety within a collection with another similar variety if necessary.
 
5. Replacement Guarantee
We take great pride in the quality of our roses and all orders are checked before dispatch to ensure that they are in excellent condition.  We will replace free of charge any rose which fails to grow to a satisfactory standard within 12 months of the date of dispatch, provided that they have been planted in accordance with our Hints on Planting and Growing.
Roses must be returned to us at your expense for our inspection to determine whether a replacement is appropriate. 
We cannot accept responsibility for any plants which fail to grow as a result of adverse weather conditions, improper husbandry or other factors beyond our control and a replacement will not be provided should a rose fail to grow as a result of any of these matters.
In the event of a replacement of the same variety not being available, we will provide a replacement as close to the original variety as possible.
The Replacement Guarantee does not apply to the free rose received when you Recommend a Friend.

6. Recommend a Friend
If you complete a friend's details who are not already on our database of customers on the order form, we will add them to our mailing list.
With your order, we will enclose a free rose of our choice as a token of our thanks.

7. Legal
All varieties marked with † are subject to Plant Breeders Rights in terms of the Plant Varieties and Seeds Act 1964.  These varieties may not be propagated for sale or sold, except under licence from the holders of the Rights.
In terms of the Offensive Weapons Act 1996, secateurs will not be sold to persons under the age of 16.
These Terms and Conditions do not affect your statutory rights.
